“Competition Period” 8:00 am on 11 November 2019 (Monday) to 5:00 pm on 24 January 2020 (Friday) (ACST)

 

Terms and Conditions

ENTRY

  1. “Eligible Entrants” Entry to the Competition is open to all participants of the Territory, who fulfil the “Entry Requirements” section, submits the competition in accordance to “How to Enter” section and are not a Restricted Entrant.
    a. The entrant is responsible for ensuring his or her familiarity with the terms and conditions at the time of participation.
    b. This competition is only open to private buyers (i.e. other than those entitled to fleet discounts).
  2. “Restricted Entrants” The following are considered “Restricted Entrants”:
    a. Directors, management, and employees (and their Immediate Families) of the Promoter are ineligible. “Immediate families” means spouse, partner, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether they live in the same household as the director, manager or employee.
    b. All fleet eligible clients.
  3. “Entry Requirements”
    a. Entry to the competition is only valid when the vehicle is sold and delivered within the Competition Period.
  4. “How to Enter” To enter the Competition, Eligible Entrants must:
    a. Purchase new, demo or used vehicle from any dealerships that are a part of Australian Motors.
    b. Upon signing the vehicle purchase contract, input full personal information into the competition registration form.
    c. Tear off the purchaser’s portion and keep as ‘proof of competition entry’.
    d. The physical ‘proof of competition entry’ must be brought during the drawing event.
    e. Photo(s) of ‘proof of competition entry’ is not an acceptable form of proof.
    f. Submit a completed form within the Competition Period described above.
  5. “Maximum Number of Entries”
    a. Eligible Entrants are permitted to submit more than one (1) entry.
    b. One (1) vehicle purchase equals one (1) entry.

 

PRIZE

  1. “Prize” The Promoter will conduct a random prize draw at 10:00 am on 25 January 2020 (Saturday) (ACST) at 13-17 Goodwood Road, Wayville SA 5034.
  2. “Purchased Vehicle Price” The price of the vehicle, excluding on-road costs (i.e. stamp duty and registration charges), accessories, warranty, roadside assistance and insurance products.
  3. “Prize Draw Details” One (1) winner from the competition will receive a cash prize that is equivalent to the Purchased Vehicle Price or up to a maximum of $40,000.
  4. A vehicle purchased is considered as an entry to the Australian Motors Australia Day Give Away.

 

PART A – INTRODUCTION

  1. Information on How to Enter and Prize details form part of these terms and conditions.
  2. By participating in the Competition, entrants accept and agree to be bound by these terms and conditions. For the avoidance of doubt, the terms and conditions include the Schedule above.
  3. Entries must comply with these terms and conditions to be valid.
  4. Where there is any inconsistency between the Schedule and Parts A to L of these Terms and Conditions, the Schedule will prevail.

 

PART B – PRIVACY

  1. The Promoter will collect and use each entrant’s personal information for:
    a. conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) and for promotional purposes, public statements and advertisements in relation to the Competition;
    b. providing information about the products and services offered by the Promoter and its related companies and its affiliated retailers; and
    c. research to improve its products and services.
  2. By entering the Competition, entrants’ consent to the use of their personal information as described in Part J of this Schedule.
  3. Entrants may access, change and/or update their personal information in accordance with the Promoter’s privacy policy [https://www.australianmotors.com.au]

 

PART C – WHO CAN ENTER THE COMPETITION

  1. If the Schedule permits entrants to be under the age of 18 years, such entrants must seek permission from their parent or guardian to enter. If the winner of a Prize is under 18 years of age, the Prize will be awarded to the winner’s parent or legal guardian.
  2. Only Eligible Entrants may enter the Competition.

 

PART D – HOW TO ENTER THE COMPETITION

  1. To enter, each entrant must comply with the “Entry Requirements” and “How to Enter” sections of the Schedule.
  2. Eligible Entrants may submit up to the Maximum Number of Entries. If the Schedule permits entrants to submit more than one entry, each entry must be unique and submitted separately.
  3. Entries must not have been published or submitted previously or used to win prizes in other competitions.
  4. An entry cannot be modified after it has been submitted.
  5. The Promoter reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the Competition of all entrants. The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter.
  6. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these terms and conditions or which contravene any applicable laws or regulations.
  7. The Promoter reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these terms and conditions, has engaged in unlawful or improper conduct or otherwise acts to cheat or undermine the fairness of the Competition by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants.
  8. The eligibility of entries is solely within the discretion of the Promoter.
  9. The Promoter accepts no responsibility for late, lost, misdirected or damaged entries or other communications.

 

PART E – PRIZE

  1. The prize is not transferrable, exchangeable or redeemable for any goods.
  2. Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for the Prize being damaged, lost or stolen.
  3. All taxes (excluding GST, if any) which may be payable as a consequence of receiving a Prize are the sole responsibility of the winner.
  4. A winner’s use of the Prize is entirely at their own risk. Before a Prize is awarded, a winner may be required to sign an agreement to release the Promoter from and indemnify the Promoter against any liability arising from the winner’s acceptance and use of the Prize and the winner’s participation in the Competition.

 

PART F – HOW THE WINNER(S) ARE DETERMINED

  1. This is a game of chance. The draw/s will be conducted in accordance with the Prize Draw Details. Prize(s) will be awarded to the valid Eligible Entrant(s) randomly drawn in accordance with the Prize Mechanic.
  2. The judges’ decisions are final, and no correspondence will be entered into.
  3. The winner will be awarded the “Prize” specified in the Schedule.

 

PART G – NOTIFICATION AND CLAIMING THE PRIZE(S)

  1. The Promoter will provide the winner with instructions on how to claim the Prize. It is the responsibility of the winner to comply with the Promoter’s instructions.
  2. The Promoter reserves the right to request the winner to provide proof of their identity and/or proof that he or she was responsible for the winning entry.
  3. It is the responsibility of each entrant to notify the Promoter of any change to their contact details.
  4. The winner will be notified during the random prize draw in accordance with the Prize Draw Details.
  5. If the winner were not present at the time of the draw, the winner(s) would be notified personally by email within two (2) working days after the draw, and their names will be published on the Promoter’s websites (https://www.australianmotors.com.au; https://www.australianmotorsmazda.com.au/; https://www.australianmotorsmitsubishi.com.au/; https://www.suzukiinthecity.com.au/; https://www.australianmotorsisuzu.com.au/) on 28 January 2020 (Tuesday) before end of business hours.
  6. If the winner is not present to pick up the Prize at the time of the draw, the Promoter will use best endeavours to contact them using the contact details provided by the entrant. In the event that the Promotor is unable to make contact with the winner for any reason within three (3) months from the draw date, at the Promoter’s absolute discretion, the Promotor may determine that the winner is no longer eligible for the Prize.
  7. If required, an unclaimed prize draw may take place on 2 May 2020 (Saturday) at 10:00 am (ACST) at the Promoter’s premises located at 13-17 Goodwood Road, Wayville SA 5034 to award any prizes that are won, but unclaimed, subject to any directions from a regulatory authority. The winner, if any, will be notified personally by email after two (2) working days of the draw event and the winner’s name will be published in a post from the Promoter’s website (https://www.australianmotors.com.au; https://www.australianmotorsmazda.com.au/; https://www.australianmotorsmitsubishi.com.au/; https://www.suzukiinthecity.com.au/; https://www.australianmotorsisuzu.com.au/) on 4 May 2020 (Monday).

 

PART I – NO LIABILITY

  1. The Promoter shall not be liable and excludes all liability (including negligence) for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with the Competition or the use or taking of any Prize except for any liability which cannot be excluded by law including as provided for under the Australian Consumer Law.
  2. In the event of any dispute regarding the administration, rules, results and all other matters relating to a Competition, the decision of the Promoter shall be final, and no correspondence or discussion shall be entered into.
  3. Except for any liability that cannot by law be excluded, The Promoter, its related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant (including a winner) in connection with any competition, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death. No responsibility will be taken by The Promoter or its authorised agents for entries ineligible due to technical reasons or any other reason.

 

PART J – INTELLECTUAL PROPERTY

  1. The Promoter reserves the right to reproduce names, photographs, material, comments, feedback and other identifying information provided by entrants in promotional material including but not limited to website, brochures and other online channels and the entrant provides its consent for the Promoter to do so.

 

PART K – TERMINATION OF COMPETITION

  1. The Promoter reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other people, subject to applicable laws.

 

PART L – APPLICABLE LAWS

  1. This Competition is governed by the laws of South Australia, Australia and the parties exclusively submit to the courts of South Australia, Australia.

  4. “Entry Requirements” To enter the Competition, Eligible Entrants must satisfy all criterias listed below.
    a. Book any make and model car service within the Competition Period.
    b. Complete car servicing within the Competition Period.
    c. The car servicing must be booked with any Australian Motors Service Centre.
    d. The booking must be categorised as logbook servicing. Refer to Prize Mechanic section.
    e. Upon completion of car servicing, input full personal information into the competition registration form.
    f. Tear off the customer’s portion and keep as ‘proof of competition entry’.
    g. The physical ‘proof of competition entry’ must be brought during the drawing event.
    h. Photo(s) of ‘proof of competition entry’ is not an acceptable form of proof.
    i. Submit a completed form within the Competition Period described above.
  5. “Maximum Number of Entries”
    a. Eligible Entrants are permitted to submit only one (1) entry.
    b. One (1) car service booking equals one (1) entry.

 

PRIZE MECHANIC

  1. “Prize” Three (3) winners from the Competition will receive three (3) years free servicing.
  2. “Prize Draw Details” The Promoter will conduct a random prize draw at 10:00 am on 25/01/2020 (ACST) at 13-17 Goodwood Road, Wayville SA 5034.
  3. The Prize will be presented in the form of “Australian Motors Debit Card” that can only be used in Australian Motors Service Centre.
  4. “Australian Motors Debit Card” The Prize is equivalent to three (3) years of Car Logbook Services, which is equivalent to a maximum of $1,500 total value per winner.
  5. Where there is a mention of “Three (3) years free servicing” in advertisements and marketing materials, this refers to The Prize, where it includes 3 car services or 1 service per year for 3 years up to the total value of $1500 per winner.
  6. The winner(s) can choose whether to use the “Australian Motors Debit Card” to charge on any car servicing amount as there is no limit to the charge per usage.
  7. The Prize includes only “Car Logbook Services” which refers to the car services required in accordance to the vehicle’s manufacturer’s specifications.
  8. The Prize will not be presented in the form of cash or products.

  4. An entry cannot be modified after it has been submitted.
  5. The Promoter reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the Competition of all entrants. The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter.
  6. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these terms and conditions or which contravene any applicable laws or regulations.
  7. The Promoter reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these terms and conditions, has engaged in unlawful or improper conduct or otherwise acts to cheat or undermine the fairness of the Competition by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants.
  8. The eligibility of entries is solely within the discretion of the Promoter.
  9. The Promoter accepts no responsibility for late, lost, misdirected or damaged entries or other communications.

 

PART E – PRIZE

  1. The Prize is not transferrable, exchangeable or redeemable for any goods.
  2. Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for the Prize being damaged, lost or stolen.
  3. All taxes (excluding GST, if any) which may be payable as a consequence of receiving a Prize are the sole responsibility of the winner(s).
  4. A winner’s use of the Prize is entirely at their own risk. Before a Prize is awarded, the winner(s) may be required to sign an agreement to release the Promoter from and indemnify the Promoter against any liability arising from the winner’s acceptance and use of the Prize and the winner’s participation in the Competition.

 

PART F – HOW THE WINNER(S) ARE DETERMINED

  1. This is a game of chance. The draw(s) will be conducted in accordance with the Prize Draw Details. Prize(s) will be awarded to the valid Eligible Entrant(s) randomly drawn in accordance with the Prize Mechanic.
  2. The judges’ decisions are final, and no correspondence will be entered into.
  3. The winner(s) will be awarded the “Prize” specified in the Schedule.

 

PART G – NOTIFICATION AND CLAIMING THE PRIZE(S)

  1. The Promoter will provide the winner(s) with instructions on how to claim the Prize. It is the responsibility of the winner(s) to comply with the Promoter’s instructions.
  2. The Promoter reserves the right to request the winner(s) to provide proof of their identity and/or proof that he or she was responsible for the winning entry.
  3. It is the responsibility of each entrant to notify the Promoter of any change to their contact details.
  4. The winner(s) will be notified during the random prize draw in accordance with the Prize Draw Details.
  5.   6. If the winner(s) is/are not present to pick up the Prize at the time of the draw, the Promoter will use best endeavours to contact them using the contact details provided by the entrant. In the event that the Promotor is unable to make contact with the winner(s) for any reason within three (3) months from the draw date, at the Promoter’s absolute discretion, the Promotor may determine that the winner(s) is/are no longer eligible for the Prize.
  7. If required, an unclaimed prize draw may take place on 2 May 2020 at 10:00 am (ACST) at the Promoter’s premises located at 13-17 Goodwood Road, Wayville SA 5034 to award any prizes that are won, but unclaimed, subject to any directions from a regulatory authority. PART I – NO LIABILITY

  1. The Promoter shall not be liable and excludes all liability (including negligence) for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with the Competition or the use or taking of any Prize except for any liability which cannot be excluded by law including as provided for under the Australian Consumer Law.
  2. In the event of any dispute regarding the administration, rules, results and all other matters relating to a Competition, the decision of the Promoter shall be final, and no correspondence or discussion shall be entered into.
  3. Except for any liability that cannot by law be excluded, The Promoter, its related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant (including a winner) in connection with any competition, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any pof their personnel); and (iii) any liability for personal injury or death. No responsibility will be taken by The Promoter or its authorised agents for entries ineligible due to technical reasons or any other reason.

 

PART J – INTELLECTUAL PROPERTY

  1. The Promoter reserves the right to reproduce names, photographs, material, comments, feedback and other identifying information provided by entrants in promotional material including but not limited to website, brochures and other online channels and the entrant provides its consent for the Promoter to do so.

 

PART K – TERMINATION OF COMPETITION

  1. The Promoter reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other people, subject to applicable laws.

 

PART L – APPLICABLE LAWS

  1. This Competition is governed by the laws of South Australia, Australia and the parties exclusively submit to the courts of South Australia, Australia.

Terms and Conditions

ENTRY

  1. “Eligible Entrants” Entry to the Competition is open to all participants of the Territory, who fulfil the “Entry Requirements” section, submits the Competition in accordance to “How to Enter” section and are not a Restricted Entrant.
    a. The entrant is responsible for ensuring his or her familiarity with the terms and conditions at the time of participation.
    b. This Competition is only open to private buyers (i.e. other than those entitled to fleet discounts).
  2. “Restricted Entrants” The following are considered “Restricted Entrants”:
    a. Directors, management, and employees (and their Immediate Families) of the Promoter are ineligible. “Immediate families” means spouse, partner, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether they live in the same household as the director, manager or employee.
    b. All fleet eligible clients.
  3. “Entry Requirements”
    a. Entry to the Competition is only valid when the car service is booked and completed within the Competition Period.
  4. “Entry Requirements” To enter the Competition, Eligible Entrants must satisfy all criterias listed below.
    a. Book any make and model car service within the Competition Period.
    b. Complete car servicing within the Competition Period.
    c. The car servicing must be booked with any Australian Motors Service Centre.
    d. The booking must be categorised as logbook servicing. Refer to Prize Mechanic section.
    e. Upon completion of car servicing, input full personal information into the competition registration form.
    f. Tear off the customer’s portion and keep as ‘proof of competition entry’.
    g. The physical ‘proof of competition entry’ must be brought during the drawing event.
    h. Photo(s) of ‘proof of competition entry’ is not an acceptable form of proof.
    i. Submit a completed form within the Competition Period described above.
  5. “Maximum Number of Entries”
    a. Eligible Entrants are permitted to submit only one (1) entry.
    b. One (1) car service booking equals one (1) entry.

 

PRIZE MECHANIC

  1. “Prize” Three (3) winners from the Competition will receive three (3) years free servicing.
  2. “Prize Draw Details” The Promoter will conduct a random prize draw at 10:00 am on 25/01/2020 (ACST) at 13-17 Goodwood Road, Wayville SA 5034.
  3. The Prize will be presented in the form of “Australian Motors Debit Card” that can only be used in Australian Motors Service Centre.
  4. “Australian Motors Debit Card” The Prize is equivalent to three (3) years of Car Logbook Services, which is equivalent to a maximum of $1,500 total value per winner.
  5. Where there is a mention of “Three (3) years free servicing” in advertisements and marketing materials, this refers to The Prize, where it includes 3 car services or 1 service per year for 3 years up to the total value of $1500 per winner.
  6. The winner(s) can choose whether to use the “Australian Motors Debit Card” to charge on any car servicing amount as there is no limit to the charge per usage.
  7. The Prize includes only “Car Logbook Services” which refers to the car services required in accordance to the vehicle’s manufacturer’s specifications.
  8. The Prize will not be presented in the form of cash or products.

 

PART A – INTRODUCTION

  1. Information on How to Enter and Prize details form part of these terms and conditions.
  2. By participating in the Competition, entrants accept and agree to be bound by these terms and conditions. For the avoidance of doubt, the terms and conditions include the Schedule above.
  3. Entries must comply with these terms and conditions to be valid.
  4. Where there is any inconsistency between the Schedule and Parts A to L of these Terms and Conditions, the Schedule will prevail.

 

 

PART B – PRIVACY

  1. The Promoter will collect and use each entrant’s personal information for:
    a. conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) and for promotional purposes, public statements and advertisements in relation to the Competition;
    b. providing information about the products and services offered by the Promoter and its related companies and its affiliated retailers; and
    c. research to improve its products and services.
  2. By entering the Competition, entrants’ consent to the use of their personal information as described in Part J of this Schedule.

PART C – WHO CAN ENTER THE COMPETITION

  1. If the Schedule permits entrants to be under the age of 18 years, such entrants must seek permission from their parent or guardian to enter. If the winner(s) of a Prize is under 18 years of age, the Prize will be awarded to the winners’ parent or legal guardian.
  2. Only Eligible Entrants may enter the Competition.

 

PART D – HOW TO ENTER THE COMPETITION

  1. To enter, each entrant must comply with the “Entry Requirements” and “How to Enter” sections of the Schedule.
  2. Eligible Entrants may submit up to the Maximum Number of Entries. If the Schedule permits entrants to submit more than one entry, each entry must be unique and submitted separately.
  3. Entries must not have been published or submitted previously or used to win prizes in other competitions.
